China’s State Council has published a draft *amendment to the *Patent Law that could change the landscape for patent protection and law *enforcement. The draft says that if Internet service providers are aware of patent-infringing products being sold by their users, they should take effective action to block or remove the products. If they fail to do so, the draft says they are liable for patent violation. The amendment also allows courts to impose a 5-million-yuan maximum fine on convicted patent violators.
